Legally, this is true. The check was returned due to an error made by the bank. Underill Management would make no concessions as to the amount of the fees and threatened to start eviction proceedings if the fees were not paid. Underill had every legal right to do this according to their <a href="http://www.home.earthlink.net/~underillunfair/lease.pdf">7-page, single-spaced on legal-size paper, lease</a>.
